The grantor conveys a sixty (60) feet wide right-of-way from S.R. 1334 to the above described tract as previously recorded in Db. 370, pg. 1979 (ACR).
Also the grantor reserves a centerline twenty (20) feet wide right-of-way (being ten feet wide on both sides of the centerline) through the above described tract being more particularly described as follows:
BEGINNING on a point in the southern line of the above described tract in the northern line of a sixty (60) feet wide right-of-way as previously recorded in Db. 370, pg. 1979 (ACR), said point being located the following two (2) courses and distances from an existing metal fence post: (1) North 35° 19’ 19” West 87.08 feet, (2) South 74° 30’ 38” West 21.92 feet and running thence with the centerline at said right-of-way the following seven (7) courses and distances: (1) North 39° 08’ 40” West 34.43 feet, (2) North 39° 08’ 40” West 93.78 feet, (3) North 32° 34’ 55” West 145.83 feet, (4) North 79° 33’ 43” West 99.54 feet, (5) South 77° 45’ 17” West 117.88 feet, (6) South 58° 16’ 04” West 34.65 feet (7) South 77° 27’ 48” West 85.87 feet to a point in the western line of the above described tract, said point being the ending point to above described right-of-way.
The sale will be made subject to all prior liens, unpaid taxes, restrictions and easements of record and assessments, if any.
The record owner of the above described real property as reflected on the records of the Alexander County Register of Deeds not more than ten (10) days prior to the posting of this Notice is MARION EVERETT HORNEY, JR. and FRANCES BEVIS HORNEY.
Pursuant to North Carolina General Statutes Section 45-21.10, and the terms of the Deed of Trust, any successful bidder may be required to deposit with the Substitute Trustee immediately upon conclusion of the sale a cash deposit not to exceed the greater of five percent (5.0%) of the amount of the bid or seven hundred fifty dollars ($750.00).
